Tort reform legislation moves a step closer to passage
In its major provisions, the Senate version:
- Increases the non-economic damages cap from the House recommended amount of $250,000 to $350,000;
- Adds a provision regarding immunity for providers at free clinics;
- Allows the non-economic damages cap to apply to individuals or entities providing health care services to a patient;
- Modifies expert witness provisions; and
- Adds back certain provisions regarding joint and several liability, whereas the House removed such provisions from the law.
