An exempt executive
employee must have “the authority to hire or fire other employees” or must
have his or her suggestions and recommendations as to the hiring, firing,
advancement, promotion or any other change of status be given “particular
weight.” A key term in this element is
“particular weight.” Factors to
consider when determining whether an employee’s recommendations are given
“particular weight” include, but are not limited to: whether it is part of
the employee’s job duties to make recommendations; the frequency with which
recommendations are made or requested; and the frequency with which the
recommendations are relied upon.
