Under HIPAA (Health Insurance Portability and Accountability Act), psychotherapy notes are defined as notes recorded by a mental health professional documenting or analyzing the contents of conversations during counseling sessions. These notes are separate from the individuals' medical record and are not required for treatment, payment, or healthcare operations. These notes may contain sensitive information personal to the patient and are not intended for anyone other than the therapist. The psychotherapy notes receive extra protection under HIPAA and must be kept separate from other records and be securely stored to protect patient privacy.  

  • Series Cutoff:  When superseded or outdated
  • Retention Period:  At the discretion of the provider
  • Disposition Action:  Securely destroy or delete
