University resolves litigation over Cequa patents

The Curators of the University of Missouri announce the dismissal of Civil Action No. 4:19-cv-00143-GAF filed in the United States District Court for the Western District of Missouri, Western Division.   

The university brought this action against former professor Ashim Mitra and others alleging that the professor was obligated to assign his interest in certain patent applications and further making allegations pertaining to the proper named inventors on the issued patents.  All of the patents and intellectual property rights involved in the action are fully owned by the Sun Pharma group and relate to its Cequa™ ophthalmic product, approved as a treatment for dry eye.    

The university has dismissed all of its claims against all of the parties in the lawsuit with prejudice.  The university has resolved the claims regarding its interest in Mitra’s interest in the patents confidentially and to its satisfaction. After further investigation, the university has withdrawn and dismissed its claims regarding inventorship and acknowledges the inventors are properly named and that no additional parties should be included as inventors on the patents or patent applications.
